Legal Question in Family Law in New Jersey

Enforcing divorce agreement

In my divorce agreement it says that both parties will be responsible for paying college cost for the children, yet when I tried to have that enforced the judge denied it with no explanation. Our son has been going to college for 4 years now and the father has not paid a dime. Denied financial aid for 3 years, 1 year we did receive it because of a loss mother and husband had on a house husband sold at a loss. How can we get the court to enforce the fathers obligation to help with college. He refuses because he thinks son should pay for it by working and loans.

Re: Enforcing divorce agreement

What you are describing is something I am not familiar with. There must be some unusual factor for a judge to fail to enforce the obligation of a parent to pay for college to the extent that the parent is able.

You can call me to discuss the matter, if you want.

Re: Enforcing divorce agreement

I am very surprised at what you describe. There must be something else causing the Judge to deny your demand. I suspect that you did not have an attorney representing you, and I suspect that caused you to fail on this motion (that happens quite often, unfortunately). I can not tell for certain, however.

You may want to file another motion to force him to pay for college. You may want to examine child support, to see if he should pay more.
