Legal Question in Family Law in New Jersey

Enfore an agreement on custody/visitation/support

My child's father and I have agreed on child support, visitation, custody, drafted an agreement putting in all the terms we agreed to, signed it and had it notarized. Do we have to go to court to have it put on the record somehow? Or can I just go to court to enforce it, if it is breached inthe future? Thank you.

Re: Enfore an agreement on custody/visitation/support

It's your choice. It's a question of whether or not you want to spend time and money now or latter. My suggestion is that it be done now. Usually, when there is a breach, there is a time problem. It may take a little longer if there is no existing docket number and/or a file for the Judge to refer to. Also, psycologically, it lends a little more formality (and thus importance) to the document if there is a Judge's signature on it. This advice is based purely on the little bit of information that you have given to me. There certainly may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since it appears that you have not retained an attorney, before you take any further action, you should contact an attorney (either me or someone else) to discuss your matter in more detail. Only then will you be able to rely on the advice. I will be happy to assist you. However, you need to call me at 856-546-8010. Good luck! Rob Gleaner
