It's your choice. It's a question of whether or not you want to spend time and money now or latter. My suggestion is that it be done now. Usually, when there is a breach, there is a time problem. It may take a little longer if there is no existing docket number and/or a file for the Judge to refer to. Also, psycologically, it lends a little more formality (and thus importance) to the document if there is a Judge's signature on it. This advice is based purely on the little bit of information that you have given to me. There certainly may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained.
