Legal Question in Family Law in New Jersey
Equitable distribution, Alimony and Child support
My wife left me with my child after 3 years of marriage. She is not even in the United States now. I live in NJ. There is a divorce case pending in the court.
1. I calculated the total savings between the time we got married and the time I filed the divorce complaint. She did not contribute anything. It comes to $40000. Can someone tell me the worst and best case of how much I would be expected to pay her? I am thinking a worst case of 50% and a best case of 30%.
2. We have a joint marital property. Buying price $333000, Downpayment - $33000, Bank loan - $300000. Current value $315000. In this case, how much would I be expected to pay her off? Can I buy her share instead of foreclosing on the property? She is sitting in a foreign country and not co-operating for anything. Can a court order her to either relinquish her interest or order me to pay up something and transfer the deed in my favor if she is not co-operating?
3. How much alimony do I owe her given that the marriage lasted only 3 years?
4. Will child support be per US standards for a child living in a third world country?

Re: Equitable distribution, Alimony and Child support
It is impossible to answer your questions without substantially more detail. I am, however, concerned about your statement that "a divorce case" is "pending in the court". Who filed it, you or your wife? Was an Answer or Appearance filed? Are there attorneys involved? If you have a pending case that you filed on your own, you need to get an attorney immediately. If an attorney filed for you, that attorney can and should answer your questions. In any case, your situation is far more complicated than that which you should be handling on your own. Seek legal counsel immediately. Good luck! Rob Gleaner
