Equitable Distribution
Hello, my spouse for the last 23 years has recently
filed for divorce from his wife who has contested his
last 3 divorce attempts over the years which were then
dropped due to financial reasons.
They were married in Pa. seperated in Pa. and both
now live in NJ. He has filed for divorce again and she
is now demanding alimony and half of everything that
she had no part in aquiring. How do the Equitable
Distribution laws apply in NJ to this situation ? Her
Lawyer said something about proving the marriage
was irretrivably broken 25 years ago, which seems
obvious to us because we have a 20 year old son
together and have been living as husband and wife for
23 years . Thank You

Well, whatever else the man in your life may be, he is evidently not legally your "spouse," so you should not refer to him that way.
Clearly, "Mr. Right" has been engaged in a rather long-term scam, of which you have been an evidently quite willing victim.
I simply don't buy Mr. Right's "explanation" that he tried getting divorce on three prior occasions but had to drop them because he didn't have the money. If he really wanted to get divorced, he would have done so. If he truly has been physically separated from wifey for decades, he certainly would have grounds for the divorce.
I am reasonably sure he is probably just "shining you on" even now.
If you REALLY want to know what is going on in the current court proceeding, and what happened in the prior divorce actions, then you need to look at the actual court files.
Have you done that yet?
