ex-husband not paying alimoney despite court order

my property settlement states my ex-spouse must pay me weekly alimoney but to date he has not paid a dime. It is taking forever for the county probation department to establish the account and I hear it can take up to eight months to establish. I am almost three months without the alimoney payments. What can I do? Should I file a motion or wait for County to establish account? Isn't this a violation of a court order?

I would immediately file a motion to enforce the property settlement agreement. It is his obligation to make the payments until the account is establish.

You should not wait. Either go to the Family Intake and file the motion yourself to find him in violation of litigant's rights, go to your attorney to do it or contact us. Any fees should be paid by your ex-husband, but we would need an initial retainer which would be returned to you when he is ordered by the Court to pay.

You should file a motion; your former husband is required to pay WHILE the account is being set up.
