Legal Question in Family Law in New Jersey

Can an existing order be ammended

My sons father has an existing visitation with our 9 mos old but each time his father picks him up and returns him he cries for hours. He was also granted overnights; I thought my son will pass out from crying when he returned him. Mind you I am still breast feeding. We have to go back to court on the 14th but this is horrible for my son. What do I do? Please help

Yes of course. In fact, there are a decent amount of cases where orders get changed constantly.

Re: Can an existing order be ammended

First of all, orders involving parenting time are always subject to further review. In fact, your case is already being reviewed on November 14, 2007 as I read your question. There are many points of view about when bonding begins but many socalled experts claim that parental boning is very significant in the first year.

There are many resources such as parenting classes, possibly you could spend more time with the other parent for the sake of the child to explain the child's needs and give the child a better comfort level. There are many facts I would need that could assist me in leading you in the right direction. Without more facts that might involve an hour or more interview, I am relly only speculating as to what might help.

Perhaps you and the father have a poor relationship and the child senses your tension level even though you are not aware that you are projecting tension or body language to the infant. If that is the case, then having another person transfer the child to the father might be helpful. I am assuming that you are able to express milk for the baby.

The question also arises as to whether you really want the child's father to be involved and you may not for a good reason. These are complex matters and perhaps a parenting coach may be available to assist. That must be weighed against the potential issues that a disinterested dad may cause in the long run. Some counties have on-staff people to assist in these matters. Check with your county.

As I stated, we must have more information to better help you but I hope you will find something here helpful. Best of luck!
