Legal Question in Family Law in New Jersey

False accusation

My ex-wife filed a restrainer order to avoid contact with her. Among the accusations, she accused me of being an alcoholic. Can I take her to court for making such false accusation without having any proof of it?

Re: False accusation

You can not sue her for slander if she says in court pleadings that you are an alcoholic. And no responsible divorce attorney should tell you otherwise.

These kinds of accusations are very very common in divorce situations. You need to focus on the important issues, not on nasty statements by your ex-wife.

And you need an experienced divorce attorney to assist you. Do not do this on your own. You may cause serious harm to yourself that might be avoided.

Re: False accusation

Yes, you can. In fact, this is something I have done as much as possible. We just finished a case last week where we had our client do this and I believe it helped lead to the RO being dropped. I also had a nother client press 5 charges against the person that pressed 1 charge on him. I can also represent you as a private prosecutor on these charges as well as defend the RO.

My consultations are always free and I have a state-wide practice. Call me at 732/247/3340 and we'll discuss your case your options.
