Legal Question in Family Law in New Jersey

This is a two part question:

1) My daughter was injured as a result of the negligence of a state employee... I file my notice of intent, do I need to still file my tort claim before I file my summons?

2) How can it be legal to prosecute a person civilly and the criminal case is closed without any charges filed? My husband was falsely accused of sexual molestation. After the investigators found out it was not true... DYFS stepped in and file a civil case... he was never arrested or charged and the criminal case is concluded. How is this even legal???

Sounds like you need a good attorney that handles these types of cases. I sometimes handles cases like this, but I don't think my current case load would allow me too. I would have to refer you to someone.
