I am curious matrimonial/divorce law in New Jersey. I have a case in which a woman who has been married to a very wealthy man for fifty years is divorcing him. She has been a homemaker and has not been employed throughout the whole marriage. Legally, what is she entitled to? Are there certain rights that she is entitled to under NJ law? Perhaps it varies with every divorce case. If you cannot answer my question, can you please direct me towards anyone who can or direct me towards some reputable legal resources? Thank you very much.

In general terms only, and these may or may not apply to her depending upon the exact facts of her situation:
1. she will be entitled to a portion of the assets accumulated during the marriage - this is called "equitable distribution".
2. she will very very likely be entitled to permanent alimony, payment from her husband to her, to support her.
3. she has other rights as well, and some of these rights depend upon the ages and circumstances of the children.
this is only a very, very general summary. she should speak to a divorce attorney to get some advice.

There are definite issues of alimony and equitable division of the property acquired during the marriage. Under the NJ laws all assets and income acquired during the marriage are presumed to be the result of the combined efforts of the parties. This is a long term marriage and the husband apparently has resources so that permanent alimony is highly probable.
Your client will need to sit down with an experienced family lawyer and discuss her rights to get a big picture specific to her life over the past 50 years.

A lengthy marriage usually entitles one to an equal share of what has been acquired in terms of property (equitable distribution) and possible alimony.
The exact contours of each case differ and for that reason the lady should consult with counsel. Consider consulting with counsel as soon as possible.
