Looking to get legally separated. What does that mean?

In New Jersey, I really don't suggest it. Make an appointment with an attorney. It should cost you nothing. The attorney should be able to give you all of your options and you make a better choice at that point. Call me at 732/247/3340 to discuss.

An action for a legal separation is for a divorce without a divorce. You would still be married, but issues of child custody and support; the distribution of marital assets and alimoney would be resolved. No one does this because it is an action designed for Catholics from the time that a divorce was viewed as a violation of their Christian values.
If you do not want a divorce, but to live separately, you can simply enter into a property settlement agreement and thereby resolve all the issues of a divorce and then file for divorce when you are so inclined

In New Jersey there is no such thing as "legal separation". However, an agreement can be drafted to define rights and responsibilities that would be enforceable if either party files for divorce.
