Legal Question in Family Law in New Jersey

Family Law Problems

My girlfriend has a crazy ex-boyfriend who is harrassing us. He leaves obscene messages on her phone and calls constantly. In addition he has her car and refuses to give it back. What can be done?

Re: Family Law Problems

This appears to be harrassment as defined by the Domestic Violence laws. During the day, your girlfriend should go to the Family Intake desk at the Courthouse in your county and tell them that she wants to sign a Domestic Violence Complaint. They will guide her through the process. As part of the relief requested, she should ask the Judge to order the return of the car.

Keep in mind that this advice is based purely on the little bit of information that you have given to me. There certainly may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since it appears that you have not retained an attorney, you may want to contact a Family Law attorney (either me or someone else) to discuss your matter in more detail. Only then will you be able to rely on the advice. If you call me, mention Law Guru and your first one hour consultation will be free. Good luck! Rob Gleaner

Re: Family Law Problems

File a complaint with the police for aggravated harassment, and auto theft. If the car is new then file a complaint for grand auto theft.

Re: Family Law Problems

Just go to the police and sign a complaint. You don't need an attorney of this. However, if your girlfriend wants a restraining order, she is permitted to get an attorney to represent her. Otherwise, she will be representing herself.
