Legal Question in Family Law in New Jersey

Family Plan

My fiancee and i just broke up. We were together for 6 years and have a child together. We are on good terms, and both agree that our son should live with me. We do want to create a ''family plan'' or similar document, that outlines child support, visitation, etc. Can you please tell me a little bit about this type of document? Particularly, what its called and what the actual document covers. I understand it is filed with the court. Do we have to go to court, or is it just a document that is filed on our behalf? Can we do it together, i.e., use the same lawyer, or is that completely unheard of? And my last question, I live in NJ (with our son), and he lives in NY... where would these documents need to be filed? Thank you, Lisa

you can file a "separation agreement" with all the terms you just stated (custody, support, etc.), and it can be made a part of the court record by agreement. Normally, there is no court appearance, and if there is one, it is short and to the point (they would just put it on the record that this is the agreement and it was done willingly, freely, etc.). I would recommend you file it in the state where the "primary custodian" resides, so in this case, that would be your state of residence, NJ. Please call my firm for a free initial consultation.
