I have separated from my husband from one month now. he has my child who is 5 years of old and going to Kindergarten. What is the best possible way to my child from him?

I can not tell from the little information that you gave, whether you will need a New York attorney or a New Jersey attorney; it would take 30 seconds on the telephone for me to figure that out.
From what you have said, it seems very likely that you are going to have to start a divorce. You need to solve some problems in your life and your child's life.
A divorce might be needed; that is what I understand that you are saying.
Employment, income to pay the family's expenses, is an issue.
You have kids: custody and vistation, and child support are issues.
Child support and college tuition needs to be paid. Measured in tens of thousand of dollars.
