family rights in the case of an adoption

my youngest sister just had a baby that she is being basically forced to give away by the father. the father is not a citizen but here on a student visa to attend school, but does not want her to give the baby to a family member, 3 of us including my mother wants him. the couple that is planning to adopt the baby, says they were under the impression that no one in the family wanted the baby,(per the father) however now that they do know they are using a power of attorney to facilitate the adoption...my mother has since applied for custody since the baby is now critical and still in the hospital and my sister has admitted that mentally she is now together. Can we stop this process to get the baby and is a power of attorney a legal way to adopt a baby? What can we do

You cannot adopt by use of a Power of Attorney. There are many issues here that need to be dealt with in order to have this adoption become valid. You definitely need an attorney.
