Legal Question in Family Law in New Jersey

what happens when father has dementia?

MY father is married for 10 years. He is now with dementia. My father owns 2 homes and $$$$. The home I am living in was my home I grew up in. almost 32 years now. Now my father wants to sell it. I feel the wife is behind this for the money.

What rights do I have for him not to sell? Knowing that he cannot make desions and he is the soul owner of this home.

He and she had made verbal statements through out the years that I will never be thrown -out nor would he sell as long asI am here.

What can I do to stop him from selling this place knowing that he does have dementia and that he made they made the vebal aggreements?

Please help me.

Re: what happens when father has dementia?

You may be able to have a Court determine whether or not he is competent to handle his affairs. Unfortunately, his wife may apply to become the guardian and then you and she would have to fight it out before a Court to determine who would become the guardian. Your question is quite complicated and I would suggest that you speak with an attorney as soon as possible to determine options. If you want to speak with me about this, please call me at 609-546-8010. Good luck!
