Legal Question in Family Law in New Jersey

Father Works During His Parenting Time

Father and I were never married and have a 1 year old child. In December he

put in a motion for increased parenting time and in January was granted it.

Court order reads: Joint Custody. Parenting plan is as follows: Mon-Wed

includes 2 overnights and from Thur-Sat. 10-3p.m. Father has a heavy work

shedule and is on call everyday. Since March I have found out he is working

during his days and overnights and is not with child. He gave the impression

to the judge that he had all this time to be with her. I have tried to discuss

this matter with him and he tells me ''he can leave her with whoever''. I am

concerned about the safety of our child and feel since he was granted all this

time he should be with her and not with legal strangers. Our court order has

no guidelines such as right of first refusal. I have the time to spend with her

if he has to work. Is this schedule normal for a child this age? Would

appreciate any advice!!!

Re: Father Works During His Parenting Time

Go back to court for modification of visitation schedule based upon records of father's work

hours.
