Legal Question in Family Law in New Jersey

Father's Rights in adoption when parental status unknown

I am 25 years old at age 18 I had a son. In an open adoption I placed my child up for adoption. I did not name the childs father on the birth certificate. I would now like to tell him about this child. I would like to know if he has any legal rights to this child. Would he be able to sue for custody from the adoptive parents? Would he be able to see this child? Is there any illegal actions on my part being that I did not name him on the birth certificate? Is there a such thing as illegally terminating someones parental rights? How can I protect the adoptive family and child but still tell him about the child? Is there a statue of limitations on something like this?

Re: Father's Rights in adoption when parental status unknown

There is alot more information that any attorney would need before a good answer could be given. In adoption proceedings, the Courts are usually very protective of the biological parents' rights and I am surprised that you were able to complete the adoption without naming the father, which would have then given him the right to be heard. Before you do anything, you need to immediately contact an attorney to discuss your rights and obligations. If you want me to assist you, feel free to call me at 856-546-8010.
