father's rights

wife is leaving with my son.Can't afford to stay in our rented house.She's moving in w her parents.She's telling me if I don't keep the house, I can't have overnight visits with my son.Can she dictate where I go or stay with my son?No court order is in place.Can she hold my son from me legally until we go to court? If I take him and keep him overnight, can I be arrested even though there is NO court order?

Without a court order, this situation is like the wild west. Her ability or even your's is really determined by how much the police are willing to get involved. While I doubt you will be arrested, I'm not going to say you won't be. From cases I've had, the police usually want nothing to do with a case like this.
