Legal Question in Family Law in New Jersey

I have filed for my husband to be served with divorce papers. If my husband & I verbally agree on terms, can I LEGALLY take my son (11), move into an apartment (1 mile from house) and have husband pay support BEFORE the divorce is final?

OR if we do NOT agree to terms, will it be legal for me to take my son & move out and garnish husband's wages for support? Either way, I just want to really know if I can take my son and move into an apartment.

I agree, you need to have legal counsel explore all your options with you before you resolve anything.

The home is typically one of the largest assets to be handled in the divorce, and when resolving a case, it is usually better to resolve all the issues at one time.

I would be happy to follow up with you. Please email me directly or call my office if you would like to schedule an appointment either in person or by telephone. My contact information is listed in the links below.
