Filing a cross Petition

My wife recently informed me she has filed for no fault divorce ''Pro Se'' in Camden County. She put in the comlaint that we were separated since 1997. I dissagree. Although I had no legal address in NJ (at our house), I still stayed there, and payed bills. Throughout most of our marriage, I maintained a PA address due to job regulations, and I spent two-three days per week in PA caring for my sick mother and father. (My wife and I also had a child in 1997). Furthermore she has drawn up provisions that pretty much reduce my parental rights to a weekend baby sitter (which I refuse to sign). What recourse do I have? Can I have the complaint thrown out based on the fact that we were still living together up until a few weeks ago?

In fact, you may, in the eyes of the law, be separated due to your PA residency. However, this is a non-issue. The more important issue is what will happen with you and your children. You need to seek a good lawyer in your area (Camden County) to protect your rights. Since it appears that you have not retained an attorney, before you take any further action, you should contact an attorney in your area to discuss your matter in more detail.
