Legal Question in Family Law in New Jersey
Filing motion for divorce in another state
Can i file a motion for divorce in NJ( i meet residence requirements) if my wife currently has filed a motion for separation in NY? (she lives in NY)
Will the NY action prevent me from filing in NJ ??

Re: Filing motion for divorce in another state
Yes, you can file this type of motion. It may well be in your best interest to do this.
It is hard to say which state will ultimately grant the divorce. But if you do not file anything in New Jersey, New York will grant the divorce. The laws in New Jersey may be more favorable in your situation.
