Legal Question in Family Law in New Jersey
Filing a Motion
I filed a motion in September of 2008 to get my ex-husband to pay his share of my son's college expenses, I was granted everything. My ex had 30 days to pay me, he didn't. I filed a motion to enforce rights, forgot to resubmit all the receipts, so the judgement said I was denied because I had no receipts, then I filed a reconsideration, denied because I had failed to submit receipts with the motion to enforce rights. So now can I start over and file a motion to enforce the original motion of october 2008? I just don't understand how my ex can defy a court order and get away with it, just doesn't seem right, isn't that contempt? So can I re-file now?

I agree with Mr. Davies. Might be time to get an attorney. I practice in every court in NJ so call me at 732/247/3340 to discuss further.
Re: Filing a Motion
I sympathize with your problems. Even experienced attorneys sometimes have trouble getting the Court to act. It is much more difficult for you.
And I understand that you are paying for college, so paying a lawyer is difficult. Still, I must say what is obvious: you have tried and failed for about six months on your own.
You are likely to be more successful with an attorney representing you.
Let me know if I can help you. I am in Hackensack, right across from the Bergen County Courthouse.
