Legal Question in Family Law in New Jersey
Final judgement of divorce
I was involved in a very difficult divorce. The final Judgement was April 2003. I own a small business that I feel was not evauluated properly. My attorney at the time did not put up any arguements and did not tell me I needed an ''expert'' to evaulate the business. Now after 4 1/2 years my x-wife is trying to get $32,000 from me that was owed to here from the business. Nothing has been done since the final judgement. I want to srgue the date of the evaulation, because they used the date we filed for divorce for evaluation, but I have a court order showing that we were to use the business checking account to pay for bills and leagle cost. The business is a one man operation and it has not been doing well from before the divorce started. Can I appeal the final judgement of divorce or at least the date of evaluation?

Just a little too late for a direct appeal (you have 45 days). Your best bet is the fight this from multiple angles. You need to take her issue head on. You also need to attack the JOD itself.

If the matter was fully litigated you can file a motion to modify based on equitable principles. If you settled the case you are stuck with the valuation that you agreed to.
Call me if you like.
