Legal Question in Family Law in New Jersey
What do I do when the Final Judgment is wrong?
My ex's attorney prepared the final judgment, and it does not mirror either the Court Order, or any paperwork or transcripts from two court dates. Now the new Judge is ordering me to abide by the final judgment, because "he does not enforce transcripts." The court order specifically states what is ordered, yet this judge will not recognize it, and is ordering me to be incarcerated until I abide by the final judgment. I will lose everything, including visitation with my daughter. This judge is also re-litigating the terms of my divorce from Sept 1998, which was ajudicated twice already, now he is overruling the other judge. I know that an appeal is the proper recourse for the ex wife, but obviously the legal system works differently for her than me. Please advise.

You apparently have the transcripts and other documentation. An application needs to be made to the Trial Court to correct the mistake in the Judgement, based on the transcripts and prior orders. I need to warn you. It is not an easy task and it could be expensive. However, you seem to have alot at stake and it should be done. You should seek the advice of an attorney to review the entire situation. If you want me to assist you, call me at 856-546-8010. Mention LawGuru and the first consultation is free. Good Luck!
