Legal Question in Family Law in New Jersey
Financial Obligations
I have asked my husband for a divorce due to his alcoholism. He has recently gotten a credit card in his name and has been charging since he got it. My name is not on it the account nor have I used it. At the time of the divorce will I be held responsible.

Re: Financial Obligations
In general, any debts accumulated between the date of marriage and the date that someone files a Complaint for Divorce are considered marital debts and are subject to being allocated between the parties in a divorce. If you can prove that he charged things that were not for the purpose of household expenses or for the benefit of the marriage, you may not be held responsible. However, unfortunately, often people spend more money on attorneys fees fighting that issue, than is actually owed on the credit cards. I strongly suggest that you consider filing for divorce immediately if you are concerned about this.
