Legal Question in Family Law in New Jersey
''Forced'' to visit out of state?
We live in NY,my husband went to court in NJ to get ex to share the transportation, he has EOW visitation, the judge ordered one weekend they share the drive, the other weekend must be spent visiting in South Jersey at my husband's parents house! He barely speaks to them! The judge said, he could go to a hotel then with the 3 children. Judge feels it's too long of a ride. They've been doing it nearly 3 years, how can this be right? What is the recourse.

Re: ''Forced'' to visit out of state?
It's hard to make a judgment on a Judge's decision without knowing all of the facts. Example - if the family originated in NJ and the husband moved either during or after the divorce, then the Judge may feel that the husband created the problem and may be less sympathetic. This is only one example of any number of reasons why the decision may be fair. As to your specific questions, you can either ask for a rehearing if you think there are facts that the Judge did not consider, or you can appeal to the Appellate Division. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There certainly may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since it appears that you may have handled this matter on your own, or may not be happy with your own attorney, before you take any further action, you should contact another attorney (either me or someone else) to discuss your matter in more detail. Only then will you be able to rely on the advice. I will be happy to assist you. However, you need to call me at 856-546-8010. Good luck! Rob
