Legal Question in Family Law in New Jersey
foreign parent threats to take child
I was never married to my 4 yr old son's father and he was NEVER in his life until about a yr ago. Father admitted to lying on his application for a student visa saying he had no children in the U.S. to get here. After many times in court in New York (that is where I lived until Oct. 02 when I relocated with the courts permission because I was getting married.) and repeated violations of visitation orders, a summons to appear in criminal court for assaulting me inside the queens family court etc. he resumed visitation last week. My son was diagnosed with Henoch-Schonlein Purpura on the day I went to court last (march 10th) and has suffered a lot with HSP. Today, at the doctor they found protein and blood in his urine. The doctor asked to please keep him home. If he was not willing to comply, to take him locally for a few hrs only. He, disregarding that completely, to prove he CAN, took my son anyway from our home in NJ to go to queens, NY by public transportation. He lives in a room with no bathroom or kitchen and I can never get in touch with my son when he is there. Can I request to suspend visits, at least overnight, because of innapropriate accomodations/not following medical advice? Help! Can I bring this case to Jersey?
