forging a check
Is it illegal if a wife falsifies a check from her husbands seperate checking account to pay property taxes that were over due and he refused to pay them. We are in the processs of headaing for a divorce.

I have read what the other attorneys wrote, and I agree with Gary and Jef. They are usually correct, and they are correct here.
You, madam, need a divorce attorney. It sounds like simple stupid things, like paying the taxes, are not happening because of your husband. You need a lawyer to assist you.
Now, dont take this wrong, but let me summarize:
you are going to start a divorce. You have to deal with it very soon.
you may have a job. he has a job.
you might have kids. custody could be an issue.
child support and college tuition needs to be paid. measured in tens of thousand of dollars.
you have a house, and maybe some money saved. you might have a pension plan.
and you want to do this without an attorney's advice.
Nothing that an attorney can say over this bulletin board can come close to helping you solve your problems. Careless actions by you will likely cost you thousands of dollars, make your life more difficult, and possibly cause additional harm to the kids.
Hire an attorney. Go see an experienced divorce attorney located reasonably near you, and pay the attorney to review your situation carefully with you, and give you some guidance.
Go hire a lawyer, and figure out what you want to do.

Since it is a seperate account, I would say yes, although a good attorney could make an argument to get the case dismissed. Since I handle both criminal and family law, I often have cases like this. I got the two most recent cases dismissed.

It is not legal, but I doubt that a prosecutor would have much interest because the money went to pay a joint obligation.
