Legal Question in Family Law in New Jersey
found hidingg ex-husband
My friend, who was married, divorced and continues to live in Diamondhead, MS, was granted divorce (abandonment/cruel and unusual behavior by husband) with provisions for their 4 children (CS, med. ins.) on hold until husband was properly notified. That was almost 5 years ago.
We have found the ex-husband, and have secured a process server to serve the legal documents. After that, the local authorities will have the legal "teeth" to pursue him for CS, med. ins., etc.
MS CSE says it will take 6 months to ready the paperwork that needs to be served (Their idea of serving him was to attempt certified mail, which he ignored every time.)
I do not want to lose this opportunity to serve him before he disappears again. How can this paperwork "bottleneck" be unclogged?
Thank you for any guidance you can offer.

Re: found hidingg ex-husband
Assuming this is a NJ matter, a private process server, licensed to do so in Mississippi, should be retained to serve the guy. He can then file an Affidavit that says that the guy is served. There may be some technicalities as to whether or not the service complied with Mississippi law. Therefore a consultation with a MS attorney may also be appropriate. I also assume that you have your own attorney in NJ handling this matter. He/she should be able to discuss this with you. In any case, consultation with your attorney is very important. Good luck!
