Legal Question in Family Law in New Jersey

Can I freeze my husband's assets until a divorce is settled? He has money but will not share it and I would have no way to eat or live with my children because he would withdraw it all so I could not live.

In the context of divorce proceedings, usually by request of the judge made by the filing of a Motion, assets can be frozen pending a final determination. You can also ask for pendente lite (temporary) support so that you can maintain a reasonable lifestyle pending final determination.

Keep in mind that this advice is based purely on the little bit of information that you have given to me. There certainly may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. You will only be able to rely on advice from an attorney who you have actually retained. Good luck! Rob Gleaner

You are entitled to support pendente, until the case is finally disposed of, for you and for your children. Freezing his assets must be justified by some reasonable demonstration that he may wrongfully dispose of or hide his assets. Call me at 201/342/7933.
