Legal Question in Family Law in New Jersey

i had a friend who is involved in a divorce and is seeking custody of his children and has pi's working on the case as it involves adultery and other accusations of illicit and irresponsible behavior.is it legal and legitimate for a pi to engage in sexual activity aspart of the investigation as he has told me has happened?
