FRO Hearing Today
I have my final restraining order hearing today, in seeking relief can I ask for alimony since my husband of 10 years is now out of the house, living rent free with Mom, & I have assumed all our bills. He was removed over a month ago we have 2 children 9 yrs & 15 months, I had to put baby in daycare $222 week, & pay the car, insurance, health insurance, phones, utilities & rent etc. What do I need for Judge? Also, can I seek custody? His attorney at the 2nd hearing had him file a cross-TRO & my husband stated lies about the incident that happened. He has had parenting time & paid $100 to me on his own. Am I entitiled to Alimony? What proof do I need? I have the 911 CD call, photos, dr. status notes from injuries. Husband is a binge drinker & emotionally abusive which sometimes turns violent. Thank you for your assistance.

Yes. The court has the power to order support and custody. Have your receipts and bills with you. Just understand that it will be short term and you should follow up with a Complaint for divorce or a non-matrimonial action to establish a more accurate amount of support.
As to what proof you need, you have mentioned a number of helpful items. It is impossible to answer this part of the question withoutt a full consultation.

As the other attorneys said, you cannot get alimony at this point. You need to get a divorce. You can get short term support but you need to file for a divorce. You should also have an attorney. Call me at 732/247/3340 to discuss in more detail. Best of luck at the hearing.
