Legal Question in Family Law in New Jersey

full time college student

i went to court a few months ago. my husband wanted to lower child support and emancipte my son. the motion was denied i had to prove full time student status. the college did this. health insurance was ordered reinstated for my son. now 4 months later i get a new order health insurance is revoked stating college insurance is sufficient. the judge wants proof again my son is a full time 12 credit per semester student.my son was classified in school and this followed to college. he had to complete both credit and noncredit classes. Once he does this he will take 12 credits per semester. He is considered a full time student, does the court honor that the college does and financial aid does. He also said my son dropped a class in 2006 in srping and fall and therefore he was not a full 12 credits. he withdrew a class a the professors advise to presserve his gpa. he didnt realize this would affect his support. he wont do it again. If I dont provide this within 10 days or if he is not a full 12 credits he is consisered emancipated. This is outragous the same judge said his father does not have to share in paying for college. I cant survive without this support. Will this classification have any impact. Our hands are tied.

The law is that a child is emancipated if the child is, among other things, no longer a 'full time' college student. exactly what that is, and how it is affected by whatever condition has made your son a 'classified' student, is going to be decided by the Judge based on the facts of your case. There is no way for me to give you any kind of general answer to your question.
