Legal Question in Family Law in New Jersey

what can we do?

My future husband has legal guradianship over his 3 kids, but has joint custody. The divorce/custody was finalized in April '02. We have come to find out that his ex-wife's new husband is physically abusing her in front of the kids. Also, one stipulation of the agreement was that the ex-wife was supposed to hand over a drug test by June of '02 and has not yet done so. I understand for that we shuold file a motion, but we don't know where to turn for the domestic abuse/possible drug abuse that is occurring at the kid's other home. Please advise.

There are two possible avenues to follow to a solution. A motion or an order to show cause can be filed with the court to temporarily suspend the mother's visitation with the children and to investigate the allegations of abuse. I would think that the court would seek the assistance of the New Jersey Division Of Youth and Family Services to handle the investigation. Or, one could simply file a complaint with DYFS and hope that it does it's job properly.
