Legal Question in Family Law in New Jersey

Gaining full custody of my daughter

The Mother and I have joint custody of our daughter. She has the baby 4 days of the week, and then I have the baby the rest of the week. I live at home with my parents, so the baby comes here 5 days out of the week. At 10 months old she had a yeast infection, which we didnt really question, now the baby is 14 months old, and she will not sit still to be changed. My mother had her tested and we now find that the baby is being sexually abused. I want to go to court and get full custody of my daughter, i want to make sure that that is enough to give me custody of my daughter, or if the possability remains that the mother might get custody?

Sincerely

A Concernd and worried parent.

Re: Gaining full custody of my daughter

Thank you for your inquiry.

If it has been determined that the child is being sexually abused, an Order to Show Cause must be filed on an emergent basis in order to temporarily transfer custody.

It would be my pleasure to speak to you regarding this situation. Accordingly, please feel free to contact my office at 732-246-0909.

Very truly yours,

Edward R. Weinstein
