can my girlfriend and i move in together, she is not divorced yet she has been separetd for 10 months now and has two kids 5 and 2. we are planning to move into a 3 bedroom apt. one room for her and one room for me and the other for the two kids. will there be an issue with the courts in this matter, can the husband do anything about it if all he knows is that we are just room mates. she is waiting for the 18 months so that she may get divorced, so i understand is the law in nj, althought six months ago she had a restraining order against her husband for physical abuse which she removed a month later. my question is, is there a law that will prohibit a separated woman with two kids to move in with another man and not sleeping in the same room before she is divorced? please help!

Re: girlfriend separated not yet divorced

There is no law prohibiting the two of you from living together. However, your "cohabitation" may have an impact on the issues of custody/parenting time and support. I suggest that your girlfriend consult with an attorney before making any such moves to determine what is in her best interests and so that she understands the potential consequences of such a move. If she would like to schedule a consultation with my or someone in my office, please have her call my secretary, Debbie, at 856-795-6700.
