Legal Question in Family Law in New Jersey

My girlfriend and I have a 3 year old daughter together. We have been living together for almost 4 years and the relationship is not going to work out anymore. What are my chances of getting joint custody. I provide all financial support for both of them since my girlfriend refuses to get a job or even get a driver's license.

The only issue I have is that I have a threatens violence charge on my record. I was involved with a crazy girl in 2005. We got into an argument and she called the cops on me. Since she had a 6 month daughter I was charged also with endangering the welfare of a child but that charge was dropped. During this time DYFS was called, my lawyer told me not to talk to them since there was a case pending so DYFS found me guilty. How do I get these DYFS charges dismissed and not lose joint custody of my child.These charges are from 2005 with DYFS
