Legal Question in Family Law in New Jersey

Government Entitlements

I have been married for 3 1/2 years and have been in marital counseling for three of those years. It does not look like it is going to work out. During our marriage I have been awarded by the Federal Government disability compensation of roughly $900 a month. I have also been awarded vocational rehabilitation education benefits of which the amount has not yet been determined. These benefits are in addition to the income I earn while working full time. My question is: Will these entitlements be considered as part of equitable distribution? For what it is worth I don't recall my wife being with me in combat when I sustained my disability nor while I was laid up in the VA hospital for six months afterward.

Thank You,

Re: Government Entitlements

I have no idea of how long you have been married or how long ago you were in the military service but I would think that disability benefits are not distributable. You should call me so that I may give a more intelligent response to your question.
