Legal Question in Family Law in New Jersey
I believe my granddaughter has been inappropriately touched.
My daughter's ex-husband has told someone he has been looking in her windows at her daughter. His excuse it he wants to see what goes on when her boyfriend's there. This girl is about to turn 16 years old, and as I say, he was only her step-father, and has never shown any real concern about what goes on in her life. Last night we found out that he has put his hands on her, and constantly makes remarks about her bust size (she is quite well endowed for a 16 year old), which makes her feel uncomfortable. Needless to say, she is no longer allowed to be in his company, but I'd like to know if this is justification for a complaint for child abuse, or at least, inappropriate action to a minor child. We need to do something about this man's harassment of my daughter and her children.

Re: I believe my granddaughter has been inappropriately touched.
As a former member of your daughter's household, he is included as a person under the Domestic Violence laws who could have a Complaint filed against him. She needs to immediately make an application for a Temporary Restraining Order, before the Superior Court in your county, which will ultimately lead to a Final Restraining Order, which would keep him away from her entire family. This advice is given based on the limited bit of information you have given me. Other facts may change my opinion. In any case, you should seek the advice of a lawyer. Consideration should also be given to filing a criminal complaint against him. If you want me to assist you, feel free to call me at 856-546-8010. Mention LawGuru and your first consultation is free.
