Legal Question in Family Law in New Jersey
Grandparent has boy-mother lives away
In NJ- grandparent has boy living with
her- mother brings boy in and out of
grandparent and lives 1 hr away. Mom
switched school w/
grand, then to Mom - back
to school at grand loca.
Son is part time at grand. Part time at
mom according to school
I have legal custody.
Q:
Can I make the school not allow
grandmother to make decisions and
exclude her on all points.
Q:
Can I force them to include me via the
JOD?
Due to focus on divorce and her ability
to muddle all mediation, ESP etc, at
trial, I reserved my right to make
application for physical custody
upon good cause to modify.
DYFS involved for 17 months, new case
filed by the grandmother last month
against mother for neglect. then
grandmother filed for temp custody
against the two parents. Hearing is jan
16th.
Problem- I have been living out of state
since May 2005. Ex-wife was supposed
to move and agreed. Sent all her
belongings then she filed for divorce 5
months later. Contact blocked always
Q:
Has there been case where judge
will grant temp custody to me with legal
custody - DYFS is attending
hearing. The evidence is high against
both grand and mother.
I do have an attorney -worrying

Re: Grandparent has boy-mother lives away
If you have an attorney, then I would rather not step on his or her toes. When you have an attorney, you have to trust him or her. If you can't and are second guessing his or her decisions, then its time to get a new attorney regardless of their skills. If the trust is gone, things aren't going to work.
I suggest you voice your concerns with your attorney and figure out where the two of you are going here. If you cannot patch things up, its time to move on.
