Legal Question in Family Law in New Jersey

Grandparent Custody Rights

We have full custody of our grandchild since he was born, and is now three. Our daughter and her boyfriend both agreed to this arrangement because neither one could adequately provide for our grandchild. The father has become jealous with the standard of living that we provide for our grandchild. He still is not able to provide a consistent lifestyle that our grandchild is accustomed to, although he wants custody. How can we protect the best intersest of the child and continue to make sure that our grandchild remains in safe and loving custody?

Re: Grandparent Custody Rights

hi -

the only way that it would go back to court is for one of the natural parents to go to court to seek custody. until then you're safe. if one files for a change in custody, you should probably get a lawyer to represent you in the custody case. feel free to call me at 609 263-0089 if you have any questions. good luck !!

Re: Grandparent Custody Rights

You could seek a formal order of custody, However, I can't see much of a point to force the issue at this time since you have actual custody. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since you have not retained an attorney in this case, before you take any action, you should contact an attorney (either me or someone else) to discuss your matter in more detail. Only then will you be able to rely on the advice. I will be happy to assist you. However, you need to call me at 856-546-8010. If you mention LawGuru, there will be no charge for your first consultation. Good luck! Rob Gleaner
