Legal Question in Family Law in New Jersey
Half-Sibling Visitation Rights
I have a complex story which I am unsure if anything could be done about. After my mother died, my father remarried and had a daughter with a woman. Eventually they divorced and visitation was set up. A few years later, my father passed away and for almost a decade, my brothers and myself had no contact with our half sister.
Three years ago, I happen to find my half-sister over the internet, and we became extremly close. I am in my twenties, yet she is still only 16 years old. A few months ago, my father's ex wife took my half sister out of school right before final exams and moved her to Poland ( the country in which my father's ex wife is originally from). Is there anything that can be done about this?
My half-sister and I talk daily via email or INSTANT MESSANGER and she tells me how her mother promises to return her back to the United States and how miserable she is living out in Poland. I have more than enough emails and documents, even the help of my half-sister's family on her mother's side to back me up. If I applied for visition rights, would they be met and/or will there be any problems because she is out of the United States?

Re: Half-Sibling Visitation Rights
You sound like a brother who cares, and that is terrific.
I have no idea how you get her away from her mother in Poland. I have no idea what visitation rights you have under Poland's laws.
Will her mother let her visit you in USA? can you visit her in Poland?
IF SHE LIVED IN THE USA, then it might make sense to just wait until she turns 18yrs old, and she could then just get on a bus and leave her mom and go live where she wants to. I have no idea whether it is that simple for a young woman living in Poland.
Sorry I can not give any more definite thoughts on this. Good luck to you and your brothers and sister.
