Legal Question in Family Law in New Jersey

Hello!

My ex and I have a very amicable relationship, however he and his new fiance will be moving out of state, and I would like to have something legal drawn up to make me feel better when my daughter crosses state lines for visitation. Years ago we had a very informal document notarized that has since kind of fallen by the wayside. He pays me what he can in support, when he can. My husband and I drop our daughter off on Fridays, and my ex brings her home on Sundays...everything has been decided through conversation. With his move though, I really feel like it would be in my best interest to have some actual legal recourse, should something go wrong.

My question is, what exactly can I do? Taking him to court seems harsh, and a waste of money that neither of us have, but I am not sure what else can be done.

No, you do not need to go fight in court. You hire me (since I have been doing this for a long time and I am good at it), and we write up an agreement that says what you need it to say, and you sign it and get your signature notarized, and he does the same. that will go a long way to helping you on this.

If relationship with him is really so amicable, you can file for custody with the Family Part in the

County where you reside and you and he can agree that you have custody and whatever child support arrangment which you presently have, without using a lawyer. You can go to the Family Part on your own and do this.
