Hired Attorney for Child Support

In October,2008, I retained a NJ attorney to handle a child support matter. It is now May,2009. I have been unsucessful at speaking with the attorney directly. His legal assistanct informed me that a Motion was filed, the defendant was served and the judge was going to hear the motion on paper without my presence. I now live in another state. I have recently found out that no paperwork has been filed on my behalf. The legal assistant and now asking for another CIS statement. The attorney is not communicating with me. I have forward a certified letter to the attorney still with no response. Is the attorney liable for anything since I was under the impression that he filed this case since October. I have requested a copy of all the documents and proof of filing and nothing has been sent to date. I am so frustrated. I am feeling that he is in breach of his ethical duties. What do I do at this time.

What you are describing is just wrong. The attorney is required to do the work that you hired him for.

This kind of thing should not happen.

What do you do? I have no very good suggestions, except to hire a trustworthy New Jersey divorce attorney and 1. get the child support matter handled and then 2. investigate the other attorney's actions, seek a refund of all money paid, and maybe more.
