My husband and I are married for 8 years we purchase a house last year but the house was purchased under his name only because I didnt have enough credit. We both work and pay everything mtg, bills, etc together. Now he wants to sell the house I dont want to. Being that my name isnt on the papers of the house can he sell the house on his own?

As the legal owner of the home, he can sell it, unless there is a Court Order restraining him from doing so. If you are planning to get divorced, once you file a Complaint for divorce, you can ask the Court to restrain him from selling it while the divorce is pending. Otherwise, you may be able to file a civil action to restrain the sale, however, that is not within my area of expertise. He cannot sell the house without your consent. However, if he were to attempt to sell the house, you need to file for divorce in order to obtain a court order preventing same.
