As the legal owner of the home, he can sell it, unless there is a Court Order restraining him from doing so. If you are planning to get divorced, once you file a Complaint for divorce, you can ask the Court to restrain him from selling it while the divorce is pending. Otherwise, you may be able to file a civil action to restrain the sale, however, that is not within my area of expertise. Thank you for your inquiry.

He cannot sell the house without your consent. However, if he were to attempt to sell the house, you need to file for divorce in order to obtain a court order preventing same.
