This is a miserable situation on his part. If you file a motion asking the Judge to terminate the shared custody and give you sole custody, then the Judge will have to decide what is in the best interests of your children.

Overcrowding in his apartment would be a factor in the Judge's decision. The Judge would take into account many other things as well.
