Legal Question in Family Law in New Jersey
My husband has been cheating on me and I found lastweek and tried to talk to him but he won't talk, yesterday he packed his bags and moved out, yet this morning he used his keys to come in the house and shower and eat and then left. I need to know my rights. I don't want him coming in without permission (his mother owns the home), I also need to know how to go about filing seperation papers, or even if I have to. Please help , as of the moment I can't afford a lawyer, me and the children are penniless (3 under age children), also am I entitled to any of our tax refund? Please advise. You did not post on your question what your zip code is, so I do not know if I can help you or if you are too far away.
Your situation is horrible. You should talk to a lawyer. You may be able to force your soon-to-be ex-husband to pay your bills and maybe part of your lawyer fees.
But you need help right now. Refund? yes, you are part owner of that refund. His mother's house? Please go see a lawyer about that; you and the kids need to keep a roof over your heads, and food on the table.
You have a child (children) with this person. Each child needs to be raised, in a decent apartment or house, needs to be fed, clothed, educated, sent to college maybe, and in general supported and loved. You can do the last part on your own (every kid deserves two loving supporting parents, though), but everything else takes MONEY! Money which we will attempt to get from the child's father.
You need advice from a lawyer. Be prepared to pay for the lawyer's time; it is how the lawyer pays for his/her own bills.
