Legal Question in Family Law in New Jersey

My husband and I have four children and have recently encountered some financial difficulties due to the economy. As a result of a recent health class, my 14 year old daughter felt that my husband was drinking too much and decided to go to speak with a school psychologist. The psychologist decided to report it to DYFS, which followed protocol. This led to a DYFS worker showing up at my front door with allegations of neglect. He interviewed us and asked us questions that we answered honestly. My husband stated that he has a few drinks a few nights a week, but not enough to become intoxicated. I received a formal letter from them yesterday that their neglect allegations were unfounded. However, they still want us both to undergo a drug and alcohol evaluation and participate in their "services" which consist of in-home family counseling. What are our rights if we do not wish to participate in any of their "services?"

I just got a client yesterday who is in the same situation. This needs to be handled very carefully. Since there is no court case (yet) it does not cost much to have an attorney to help you. Call me at 732/773/2768 to discuss.

I do quite a bit of parental representation in DYFS cases and would like to discuss this matter further with you, however, I do not believe that a public on line site is the appropriate forum to do so. Please contact me at 732-663-1500 to further discuss this situation.

Thank you.
